Terms of Use & Software Licence
Canary Bulls

1. Agreement
These Terms of Use and Software Licence ("Agreement") govern your access to and use of the Canary Bulls website, software, platform, applications, services, features, content and related functionality (collectively, the "Service").
By creating an account, accessing or using the Service, or clicking to accept these terms where acceptance is required, you agree to be bound by this Agreement.
If you do not agree to this Agreement, you must not access or use the Service.
If you use the Service on behalf of a business, organisation or other entity, you confirm that you have authority to bind that entity to this Agreement.
2. Eligibility
You must satisfy any minimum age or other eligibility requirements stated by Canary Bulls before creating or maintaining an account.
You must provide accurate, current and complete information when registering and must keep that information reasonably up to date.
You must not create an account using false information, impersonate another person or organisation, or create an account for another person without appropriate authority.
3. User Accounts and Security
You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account, except to the extent that such responsibility cannot lawfully be imposed on you.
You must take reasonable steps to protect your account and must notify Canary Bulls promptly if you believe your account has been compromised or accessed without authorisation.
You must not sell, transfer, share or otherwise provide access to your account to another person unless Canary Bulls expressly permits this.
4. Licence to Use the Service
Subject to your compliance with this Agreement, Canary Bulls grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Service for its intended purposes.
This licence does not transfer ownership of the Service or any intellectual property rights to you.
Except for the limited rights expressly granted by this Agreement, no rights in the Service are granted or transferred to you.
5. Canary Bulls Ownership and Intellectual Property
Unless expressly stated otherwise, Canary Bulls and/or its licensors own or control all rights, title and interest in and to the Service.
This includes, where applicable:
- software and source code;
- object code and technical architecture;
- databases and data structures;
- website design and user interfaces;
- graphics, images and visual elements;
- text and documentation;
- trademarks, names, logos and branding;
- features and functionality;
- systems, workflows and methodologies;
- proprietary materials and documentation; and
- other original materials made available through the Service.
These materials are protected by applicable intellectual property laws. Nothing in this Agreement transfers ownership of Canary Bulls intellectual property to you.
6. Prohibited Copying, Reverse Engineering and Extraction
Except where expressly permitted by Canary Bulls in writing or by applicable law, you must not:
- copy, reproduce or redistribute the Service or any substantial part of it;
- reproduce the design, structure, functionality or user interface of the Service;
- modify, adapt or create derivative works from the Service;
- reverse engineer, decompile or disassemble the software;
- attempt to obtain or reconstruct source code or underlying technical architecture;
- remove or alter copyright, trademark or other proprietary notices;
- scrape, crawl, harvest or systematically collect information from the Service;
- use bots, spiders, scripts or other automated means to access or collect information from the Service;
- reproduce Canary Bulls databases, datasets or other substantial collections of information;
- mirror, frame or reproduce substantial portions of the Service on another website or application;
- use information obtained from the Service to build, train, operate or assist a competing service where doing so infringes Canary Bulls' rights or breaches this Agreement; or
- facilitate or assist another person in carrying out any of the above activities.
Nothing in this section prevents activities that cannot lawfully be restricted by contract.
7. Canary Bulls Proprietary Systems and Confidential Information
The Service may contain proprietary systems, processes, methodologies, workflows, designs, business logic, documentation, non-public information and other materials developed or used by Canary Bulls.
You must not, except with Canary Bulls' prior written permission:
- reproduce or commercialise Canary Bulls' proprietary materials;
- disclose non-public Canary Bulls information to third parties;
- use confidential or non-public information obtained through the Service to develop or assist a competing product or service;
- reproduce substantial elements of Canary Bulls' systems, workflows, methodology or implementation; or
- assist another person or organisation to do any of the above.
This section does not prevent you from independently developing ideas or functionality without using Canary Bulls' confidential information or infringing Canary Bulls' intellectual property rights.
8. Acceptable Use
You must use the Service lawfully, responsibly and in accordance with this Agreement.
You must not use the Service to:
- commit, facilitate or encourage unlawful activity;
- deceive, defraud or scam another person;
- impersonate another person or organisation;
- harass, threaten, intimidate, stalk, bully or abuse another user;
- publish another person's private or confidential information without lawful authority;
- upload malicious software or harmful code;
- interfere with the operation or security of the Service;
- attempt to gain unauthorised access to accounts, systems or data;
- circumvent security, authentication or access controls;
- deliberately exploit vulnerabilities except through an authorised security-reporting process;
- manipulate features, rankings, reputation systems, records or other Service functionality through abusive or deceptive means;
- use the Service to distribute spam or unsolicited commercial communications;
- infringe another person's intellectual property, privacy or other legal rights; or
- otherwise misuse the Service.
9. Treatment of Users, Moderators and Administrators
You must treat other users, moderators, administrators and Canary Bulls personnel appropriately.
You must not use the Service to harass, threaten, intimidate, bully, abuse or repeatedly target another user, moderator, administrator or Canary Bulls representative.
You must not attempt to evade moderation or enforcement action by creating replacement accounts or using another person's account.
You must not encourage or coordinate other users to abuse, threaten, disrupt or target another user, moderator, administrator or Canary Bulls representative.
10. User Content
You retain ownership of content that you lawfully submit, upload or otherwise make available through the Service ("User Content").
You are responsible for ensuring that you have the necessary rights and permissions to submit User Content.
By submitting User Content, you grant Canary Bulls a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit, process and otherwise use that User Content to the extent reasonably necessary to provide, operate, maintain, secure and improve the Service.
You must not submit content that:
- infringes another person's intellectual property rights;
- unlawfully discloses another person's private or confidential information;
- is unlawful or facilitates unlawful activity;
- contains malicious code; or
- otherwise breaches this Agreement.
11. Moderation and Removal
Canary Bulls may, where reasonably necessary and subject to applicable law:
- review or moderate User Content;
- remove or restrict access to content;
- restrict particular functionality;
- issue warnings;
- suspend accounts; or
- terminate accounts.
Moderation may be undertaken to enforce this Agreement, protect users, protect Canary Bulls or its personnel, comply with legal obligations, address security concerns, or maintain the operation of the Service.
Nothing in this Agreement removes any rights you may have under applicable law.
12. Reporting and Complaints
If the Service provides mechanisms for reporting content, accounts, abuse or security concerns, users should use those mechanisms where appropriate.
Canary Bulls may investigate reports and take action where it considers action appropriate or legally required.
Where applicable law requires Canary Bulls to provide a complaints or appeals process, the relevant process will be made available to users.
13. Security and Technical Restrictions
You must not:
- probe, scan or test the vulnerability of the Service without authorisation;
- attempt to bypass authentication or security controls;
- interfere with servers, networks or infrastructure;
- introduce malware, ransomware, viruses or other harmful code;
- overload or deliberately disrupt the Service;
- attempt to access information belonging to another user;
- exploit a vulnerability for personal benefit or to harm another person; or
- use automated systems in a manner that places unreasonable load on the Service.
If you identify a potential security vulnerability, you should report it to Canary Bulls through the designated security contact or reporting mechanism rather than exploiting it.
14. Third-Party Software and Services
The Service may incorporate or interact with third-party software, libraries, APIs, payment providers, hosting providers, analytics services or other third-party services.
Those third-party services may be subject to separate terms, licences and privacy policies.
Where third-party or open-source software is provided under its own licence, that licence may apply to the relevant component.
15. Availability and Changes to the Service
Canary Bulls may modify, update, improve, suspend or discontinue features or parts of the Service from time to time.
We may carry out maintenance, security updates or other operational changes that temporarily affect availability.
Where reasonably practicable, Canary Bulls will take appropriate steps to communicate material changes that significantly affect users.
Nothing in this section limits any rights you have under applicable consumer law.
16. Suspension and Termination
Canary Bulls may suspend or terminate access where reasonably necessary, including where:
- you materially breach this Agreement;
- your use creates a security or legal risk;
- your account is involved in fraud or abuse;
- suspension is necessary to protect other users or the Service;
- Canary Bulls is required to do so by law; or
- the Service is discontinued.
Where appropriate and legally permitted, Canary Bulls may provide notice or an opportunity to remedy a breach before taking action.
Termination does not affect rights or obligations that by their nature are intended to continue after termination, including applicable intellectual property, confidentiality, liability and dispute provisions.
17. Privacy and Personal Data
Canary Bulls processes personal information in accordance with its Privacy Notice and applicable data protection law.
The Privacy Notice explains, where applicable, the categories of personal information collected, purposes of processing, lawful bases, retention periods, disclosures to third parties, international transfers, user rights and other information required by applicable data protection law.
The Privacy Notice is provided separately from these Terms.
18. Cookies and Similar Technologies
Canary Bulls may use cookies and other storage or access technologies in connection with the Service.
Information about the technologies used, their purposes and applicable consent choices is provided through the Canary Bulls Cookie Policy and cookie-consent mechanism.
Where consent is legally required for non-essential cookies or similar technologies, Canary Bulls will provide an appropriate mechanism for obtaining and managing that consent.
19. Disclaimer
To the extent permitted by applicable law, the Service is provided on an "as available" and "as is" basis.
Canary Bulls does not guarantee that the Service will always be uninterrupted, error-free, secure or available at all times.
Nothing in this Agreement excludes or limits any warranty, condition, right or remedy that cannot lawfully be excluded or limited.
20. Limitation of Liability
Nothing in this Agreement excludes or limits liability where such exclusion or limitation would be unlawful.
Subject to that limitation, Canary Bulls will not be liable for indirect or consequential losses to the extent that applicable law permits such liability to be excluded.
Nothing in this Agreement affects rights or remedies that you have under applicable consumer protection law.
21. Changes to These Terms
Canary Bulls may update this Agreement from time to time.
Where changes are material, Canary Bulls will take reasonable steps to notify users before the updated terms take effect, where required by law.
The version applicable to your use of the Service will be identified by its effective date and version number.
If you do not agree to an updated Agreement, you should stop using the Service, subject to any rights you have under applicable law.
22. Governing Law and Jurisdiction
This Agreement and any dispute arising from it shall be governed by the laws applicable to the Canary Bulls operating entity, subject to any mandatory rights or protections available to consumers under the law of their place of residence.
Any jurisdiction provision will apply only to the extent permitted by applicable law.

These Terms are intended to govern access to and use of the Canary Bulls Service. They should be read together with the Canary Bulls Privacy Notice and Cookie Policy. Nothing in these Terms is intended to exclude or restrict rights or protections that cannot lawfully be excluded or restricted.
